2. Hosting
The website is hosted by Cloudflare, Inc., 101 Townsend St, San Francisco, CA 94107, United States (www.cloudflare.com).
3. Purpose
These terms set out how the marketing website and the Argile software may be accessed and used. The software supports energy-renovation professionals with appointments, technical surveys, sizing, and the production of quotes and administrative documents.
Using the website implies acceptance of these terms. Access to the software is further governed by the subscription agreement entered into with the client company, which prevails in the event of a conflict.
4. Access to the service
The website is freely accessible. Access to the software requires a subscription and the creation of named accounts.
Each user is responsible for keeping their credentials confidential and for any action carried out from their account. Any suspicious use must be reported to us without delay.
Argile strives to keep the service continuously available, without guaranteeing uninterrupted access. Planned maintenance is announced in advance where possible.
5. User commitments
Users undertake to:
use the service in accordance with the law and with these terms;
enter only data they are entitled to use, and inform the people concerned when recording an appointment;
refrain from accessing unauthorised areas, extracting content in bulk, or disrupting the operation of the service;
check the results produced by the software before making any contractual commitment to an end customer.
6. Generated results and liability
The software relies on artificial intelligence models and on public data (in particular ADEME, energy performance certificates, land registry). The estimates, sizing calculations, surveys and documents produced are decision-support material: they remain the responsibility of the professional who validates them and passes them on to their customer.
Argile cannot be held liable for indirect damage, loss of business or loss of opportunity arising from use of the service. Its liability is in any event limited to the amounts set out in the subscription agreement.
7. Intellectual property
The website, the software, their interfaces, trademarks and content are protected by intellectual property law and remain the exclusive property of the publisher. The subscription grants a personal, non-exclusive and non-transferable right of use for the term of the contract.
Data entered by the client company remains its property. It may request an export at any time.
8. Personal data
The processing of personal data is described in the privacy policy, which forms an integral part of these terms.
9. Links and third-party services
The service may link to other websites or connect to third-party tools (CRM, accounting tools, data providers). Argile has no control over those services and accepts no liability for their content or availability.
10. Changes to the terms
These terms may be amended to reflect changes in the service or in applicable regulations. The applicable version is the one published on this page on the date of use.
11. Governing law and disputes
These terms are governed by French law. In the event of a dispute, the parties will seek an amicable solution before taking any action. Failing agreement, the competent courts are those of the publisher’s registered office, subject to the mandatory rules applicable to consumers.
